Tempur-Pedic™, Inc. guarantees that your Tempur-Pedic™ Mattress Overlay will be replaced or repaired at our option, without cost to you, should it be deemed defective because of faulty workmanship or structural defects during the five (5) year warranty period, excluding the specific limitations contained herein. It is understood that this limited warranty does not include a normal increase in softness of the TEMPUR® pressure-relieving material or a decrease in the slow recovery feature - aspects which do not affect the pressure-relieving qualities of the overlay. This warranty covers any deterioration in the cell structure of the materials that causes the overlay to have a visible indentation greater than three-fourths (0.75) of an inch, not associated with a sag in the mattress, foundation, box springs, or platform it is placed upon. It also covers any physical flaw in the overlay that causes the material to split or crack despite normal usage and proper handling. If such defects occur during this five (5) year limited warranty, we will at our option, repair the overlay at a handling cost to you, or replace the overlay at a prorated charge to you. During the first year of the warranty, the prorated replacement charge will be twenty (20) percent of the original purchase price. The prorated charge will increase by twenty (20) percent of the original purchase price for each subsequent year. The terry-cloth overlay cover is warranted for two (2) years against faults in material or workmanship. All warranties contained herein shall not apply if the overlay or cover has been physically damaged, burned, cut, or torn. This warranty is valid only to the original purchaser of the product. If the original purchaser sells the product, the subsequent purchaser takes the product "as is" and "with all faults." All transportation costs are the responsibility of the purchaser. If you did not purchase the overlay directly from Tempur-Pedic™, Inc., you must provide proof of purchase for any warranty claim.
